Upon successful registration with the Haryana Real Estate Regulatory Authority (HRERA), agents receive a unique registration number. The registration is valid for five years and can be renewed by submitting an application, which must be completed before the previous registration expires. The registration number must be included in all transactions that are completed by the agent.

  • Photograph, PAN Card, and Aadhar Card in JPEG/JPG or PNG format
  • Proof of residential address
  • Proof of business address
  • Copy of Income Tax Return, if any
  • Educational certificates
  • An affidavit attested by a Tehsildar
  • Character certificate attested by a Gazette Officer

For Companies/Firms

  • Photographs of all directors or partners
  • PAN card and Aadhar card for all directors/partners
  • Company PAN Card
  • Proof of the registered office address
  • Certificate of Incorporation
  • Memorandum of Association (MOA) and Articles of Association (AOA)
  • Details of GST registration
  • A copy of the Board Resolution (original)

Steps to get registered

The registration will be mostly online, requiring only a physical submission of documents afterward.

Preparation

Carefully read the Haryana Real Estate Regulatory Authority (Registration of Agents), Regulations, 2018 available on the HRERA website and gather soft copies of all the required documents.

Create an Account

Visit the official HRERA Website (Panchkula or Gurugram as relevant), go to the link 'Agent Registration' and click 'Signup to register an agent' to register with a user id and password. The email id will be used as the login id.

Login and Fill Application

Log in using your new credentials and click 'Agent Registration' to complete the agent registration form. Start with 'Agent Basic Details,' and then proceed through each section.

Add Director/Partner Details

If it is a firm or company application, complete the required details for each director/partner as well as upload their photographs (if applicable).

Upload Documents

In the 'Upload Document' section, upload the soft copies of all documents needed for registration. Please note that all the documents with a red star are mandatory.

Pay the Fee

Once the form is filled out, you will be required to make the applicable registration fee payment online.

Review and Submit

Before you proceed with a final submission, preview the entire application first to check for errors or omissions as you will not be able to make changes after you submit. When you make a final submission, a Temporary Agent ID will be created by the system for your records.

Submit Hard Copies

Print two copies of the application, once it is finalized. You have to submit one completed set of the application form, plus hard copies of any documents that you have uploaded to the HRERA office.

Receive Acknowledgement

When the physical documents are delivered to the authority, a receipt will be generated, and the application processing will commence.

Track Status

You will be able to monitor the status of your application by logging into the HRERA portal.

Timelines

Registration Validity

The registration of an agent with RERA is valid for a period of five years.

Issuance of Certificate

Under the RERA Act, the RERA certificate must be issued by the department within 30 days after the due approval though this may vary at the discretion of the department.

Penalties

If you operate without registration or violate RERA regulations, you could incur severe consequences:

Daily Fines

If you act as an agent and provide false information about project details and information, you could be liable for a fine up to ₹10,000 per day, accumulated fine up to 5% of the project's cost.

Legal Action

Operating as an agent without a valid RERA registration can lead to heavy penalties and imprisonment. You also could be blacklisted.

Revocation of License

Your license may be suspended or revoked by the authority if it was obtained through fraud or you fraudulently misrepresented yourself after your license was obtained. The authority will provide you an opportunity to be heard prior to suspending or revoking the registration.

Commission Cap

Agents are not permitted to charge commissions greater than 1% of the property value and that commission must be divided equally between the buyer and seller.
